TERMS & CONDITIONS

Booking with Stoop Magic

These terms apply when you browse stoopmagic.com, purchase a porch package, or use a service provided by Stoop Magic. By placing an order, you agree to the terms below.

Services & availability

Stoop Magic provides seasonal pumpkin delivery, porch design, installation, and selected add-on services in Wichita and surrounding service areas. Availability is limited by installation capacity, location, weather, product supply, and the dates shown when an order is placed.

Orders & payment

A reservation is confirmed after Shopify successfully processes payment and an order confirmation is issued. Customers are responsible for reviewing package details, selected dates, service address, contact information, and optional add-ons before submitting an order.

Installation scheduling

Customers select a requested installation week rather than a guaranteed appointment time. Stoop Magic schedules installations within that week according to location, route efficiency, weather, and availability. We will communicate material scheduling changes using the contact information provided with the order.

Changes, cancellations & refunds

Cancellations received at least 14 calendar days before the first day of the selected installation week qualify for a full refund to the original payment method. Beginning 13 calendar days before the installation week, all payments are nonrefundable because materials and installation capacity have been committed. Approved refunds may require normal payment-processing time.

Customer rescheduling

Rescheduling requests must be submitted at least 14 calendar days before the selected installation week. Requests are subject to availability and are not guaranteed. Requests received within 14 days do not restore refund eligibility. A change in date, address, package, or service area may require a price adjustment or additional travel charge.

Stoop Magic cancellations

If Stoop Magic cannot provide the purchased service because of illness, supply failure, severe weather, unsafe conditions, or another circumstance within our responsibility, we may offer a replacement date, comparable substitution, store credit, or refund for the unprovided portion of the order. This is the customer's exclusive remedy for a service we cancel.

Property access & preparation

Customers must provide safe, unobstructed access to the agreed decorating area and must remove clutter, fragile items, and hazards; secure pets; unlock necessary gates; and disable sprinklers during the service period. Stoop Magic may postpone or decline service when access is restricted, conditions are unsafe, animals are unsecured, or the space cannot accommodate the selected package.

Existing décor & property conditions

Customers must identify delicate surfaces, unstable steps, irrigation components, cameras, restricted areas, and objects that should not be moved. Stoop Magic is not responsible for damage caused by undisclosed defects, unstable structures, preexisting damage, customer-owned items left in the work area, or conditions outside our reasonable control.

Natural variation & substitutions

Pumpkins, gourds, mums, and other natural materials vary in size, shape, color, texture, and availability. Website photographs are examples, and exact replication is not guaranteed. Stoop Magic may substitute comparable varieties, colors, plants, or seasonal materials when necessary while preserving the overall value and design intent of the selected package.

Ownership & care after installation

Unless expressly identified as rented, delivered pumpkins and seasonal materials become the customer's property after installation. Customers are responsible for watering plants when appropriate, monitoring deterioration, and removing unsafe or spoiled materials. Moving or rearranging the display after installation is at the customer's risk.

Weather, wildlife & product longevity

Natural materials may fade, soften, rot, attract insects, or otherwise deteriorate. No minimum display lifespan is guaranteed. Stoop Magic is not responsible for ordinary seasonal changes, heat, freezing conditions, rain, wind, irrigation, wildlife, insects, vandalism, customer handling, or other events occurring after installation.

Incorrect address, failed access & travel

Customers are responsible for providing an accurate service address and access instructions. A failed installation caused by an incorrect address, inaccessible property, unsecured animal, or unsafe condition does not create refund eligibility and may require a return-trip fee. Travel charges outside the core service area will be disclosed before service when reasonably practicable.

End-of-season removal

Removal is provided only when purchased or otherwise confirmed in writing. Customers must provide access during the selected removal period. Removal covers eligible pumpkins and disposable seasonal materials originally supplied by Stoop Magic; it excludes customer-owned décor, planters, landscaping, household trash, and materials supplied by another business.

Photography permission

Customers may choose whether Stoop Magic may photograph the completed display. Choosing no will not affect service. When permission is granted, photographs may be used on the Stoop Magic website, portfolio, social media, advertising, and promotional materials. Personal names and addresses will not be published without separate permission.

Intellectual property & website use

The Stoop Magic name, logo, website design, written copy, original photographs, and promotional materials are owned by or licensed to Stoop Magic. They may not be copied, altered, resold, or used commercially without written permission. Customers may share photographs of their own completed displays for personal, noncommercial use.

Payment disputes

Customers agree to contact hello@stoopmagic.com promptly about an order concern and allow a reasonable opportunity to investigate and respond before initiating a payment dispute. Nothing in this section limits rights that cannot legally be waived.

Limitation of liability

To the fullest extent allowed by law, Stoop Magic is not liable for indirect, incidental, special, or consequential losses. Any direct liability arising from a specific order will not exceed the amount paid for that order, except where applicable law does not permit such a limitation.

Kansas law & standard terms

These terms are governed by Kansas law, without regard to conflict-of-law rules. Any permitted legal action will be brought in a court with jurisdiction in Sedgwick County, Kansas. If one provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These terms and the confirmed order form the entire agreement for the purchased service.

Force majeure & updates

Stoop Magic is not responsible for delay or failure caused by events beyond reasonable control, including severe weather, disasters, government actions, transportation interruption, labor disruption, or widespread supply failure. Terms may be updated from time to time; the version posted when an order is placed governs that transaction.
